PRIZE PROMOTION TERMS & CONDITIONS - FOSTERS ON PACK 2023
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.
The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at https://www.heineken.co.uk/legal-hub/brands-privacy-policy). From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).
1. Only open to residents in the UK and Channel Islands and Isle of Man aged 18 or over, excluding employees of any company in the Heineken group and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.
2. How to participate in the promotion.
o Buy a promotional pack of FOSTER’S, subject to availability. Sales are subject to discretion of checkout staff. Promotion packs are 10x440ml cans, 12x440ml cans and 18x440ml cans.
o Find a Winning Can and a Winning Ticket hidden inside a promotional pack.
o Winning Cans will be branded as “La-di-dager” and are made of solid resin material and do not contain beer liquid.
o Winning cans will be together with a Winning Ticket explaining how and who to contact to claim your prize. Prize details are set out in Term 4 below.
o There will be a unique code on the Winning Ticket. There will be a pin number on the bottom of the can.
o To claim the prize, you will be required to provide your first name and surname, date of birth and telephone number along with an photograph of both the winning can, the winning ticket including the unique code and the pin number from the can. Your standard network rates apply.
o The Promoter’s agent will verify the claim within 10 working days.
o Upon successful verification process prize money will be processed within 48 hours via bank transfer. You will require a bank account to receive the bank transfer.
o Do not dispose of the La-di-dager Can or Winning Ticket until the Promoter has confirmed your win. You will be required to send the winning ticket to the Promoter for prize verification.
3. Promotional period ends on 30th of November 2023, winners have until 4th of January 2024 to claim.
4. Prizes. There are 60 Winning Cans with Winning Tickets across all promotion packs. Each prize consists of:
1. £1,000 cash via bank transfer and
2. 18x pack of Foster’s 440ml delivered to home address of winner.
Prizes are limited to one per person.
The Promoter reserves the right to verify all entries and the winners and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding and no correspondence will be entered into.
5. The names and county of the winners will be available from customerservices@fosters.co.uk from 15 January 2023. By entering, the winner consents to first name and country being disclosed upon request.
6. There is no cash or other alternative to these prizes in whole or in part. Prizes are not transferable. The Promoter reserves the right to reclaim the prize if it is transferred.
7. Entries must be made personally. The promoter accepts no responsibility for any Winning Can or Winning Ticket that is lost. Photocopied tickets are invalid and any prize claim will be void.. The promoter accepts no responsibility for lost, damaged, incomplete, illegible or delayed entries, such entries will be void. Proof of entry is not proof of receipt and promoter does not accept any responsibility for the non receipt or the late receipt of message due to network failure or for any associated costs to entrants. No entries submitted via any other means will be accepted. The promoter cannot guarantee uninterrupted or secure access to the entry route.
8. The decision of the promoter in all matters is final and binding and no correspondence will be entered into.
9. The promoter is not responsible for any third party acts or omissions.
10. The promoter reserves the right to cancel or amend this promotion due to events or circumstances arising beyond its control.
11. All taxes (including without limitation national & local taxes) in connection with any prize & the reporting consequence thereof, are the sole responsibility of the prize winner.
12. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
